These Terms of Use (“Terms”) govern your access to and use of MormonImages.com (the “Site”), operated by Timothy P. Schreiber. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 13 years old to use the Site. By using the Site, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. Use of the Site
Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable permission to access and view the Site for personal, non-commercial purposes. The Site, including its layout, code, text, graphics, logos, and arrangement, is the property of Timothy P. Schreiber and is protected by copyright, trademark, and other applicable laws.
3. Media Licensing
Downloadable image files and related media made available on the Site (the “Media”) are not covered by these Terms alone. Any use of the Media — including download, display, modification, or redistribution — is governed exclusively by the MormonImages.com Personal Use License. By downloading or using any Media, you agree to be bound by that license. In the event of a conflict between these Terms and the Personal Use License with respect to the Media, the Personal Use License controls.
4. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law, regulation, or third-party right;
- Scrape, crawl, harvest, or otherwise systematically extract data from the Site by automated means without prior written consent, except for well-behaved indexing by public search engines;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or related systems or networks;
- Introduce viruses, malware, or other malicious code, or attempt to probe, scan, or test the vulnerability of the Site;
- Reproduce, mirror, frame, or republish substantial portions of the Site as a stand-alone resource;
- Misrepresent the source of the Site's content or remove, obscure, or alter any copyright or attribution notices.
5. User Submissions
If you send messages, requests, suggestions, or other communications through the Site (including via the contact form), you grant Timothy P. Schreiber a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, and act on those communications for the purposes of operating, improving, and responding through the Site. Do not submit confidential information or anything you do not have the right to share.
6. Third-Party Services and Links
The Site relies on remotely-hosted third-party services, libraries, fonts, analytics, and content delivery networks, and may link to third-party websites. We do not control these third parties and are not responsible for their content, terms, or practices. Your use of any third-party service or link is at your own risk and is subject to that third party's terms.
7. Privacy
Your use of the Site is also subject to our Privacy Policy, which describes how information about visitors is collected and handled. By using the Site, you consent to the practices described in the Privacy Policy.
8. Intellectual Property and Trademarks
All rights not expressly granted in these Terms or in the Personal Use License are reserved. “MormonImages.com” and the associated logo are used as identifiers of the Site and may not be used in a manner that suggests endorsement or affiliation without prior written consent.
9. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SITE OR ANY CONTENT WILL BE FREE OF VIRUSES, BUGS, OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TIMOTHY P. SCHREIBER OR MORMONIMAGES.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY CONTENT, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Indemnification
You agree to indemnify and hold harmless Timothy P. Schreiber and MormonImages.com from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
12. Modifications to the Site and Terms
We may modify, suspend, or discontinue any aspect of the Site at any time, with or without notice. We may also revise these Terms from time to time; the “Last updated” date at the top reflects the most recent revision. Your continued use of the Site after a revision becomes effective constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, intellectual property provisions, and the rules around the Personal Use License for previously-downloaded Media) will survive.
14. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State of Kentucky, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Kentucky, and you consent to personal jurisdiction in those courts.
15. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with the Personal Use License and the Privacy Policy, constitute the entire agreement between you and us regarding the Site.
